ABOUT

A Long Island based title agency built for the people who close deals.

Agent Abstract works with real estate attorneys, agents, brokers, lenders and investors throughout New York State. We keep the desk small on purpose: the person who opens your file is the person who answers your call.

Our practice is straightforward — thorough searches, early disclosure of anything that could delay a closing, and figures that arrive when we say they will. It's not complicated work. It just has to be done carefully, every time.

Estimate your title charges

Enter the transaction details for a line-item estimate of premiums, taxes, fees and recording charges — itemized the way it appears on your closing statement. New York is a filed-rate state: premiums follow the TIRSA rate manual approved by the Department of Financial Services.

Cooperative apartments are personal property, not real property. There is no owner's title policy — the file runs on a co-op lien search plus a leasehold or TIRSA co-op endorsement on the lender's policy. Call us for a co-op quote; the estimate below will not reflect it accurately.

ESTIMATED TOTALS

Seller {{ sellerTotal }}

Who pays what is set by contract and local custom — these defaults follow typical New York practice.

This is an estimate for planning only. It is not a rate quote, a commitment to insure, or a settlement statement. Final premiums and charges are set by the TIRSA rate manual in effect at closing and by the underwriter, and depend on facts the search discloses.

Recording forms

The forms we hand attorneys and lenders most often, pulled straight from the Suffolk and Nassau County Clerk form libraries and the New York State Department of Taxation and Finance. Links open the official source so you always get the current revision.

BEFORE YOU PRINT

The Suffolk Recording & Endorsement Form, RP-5217 and the Peconic Bay CPF form must be printed on legal size paper (8½ × 14) or the clerk will reject the package. RP-5217 has to be downloaded and opened in Adobe Acrobat Reader — it will not fill in correctly in a browser.

Peconic Bay towns

The CPF form is required only for East Hampton, Riverhead, Shelter Island, Southampton and Southold.

Need a form that isn't here, or want the whole recording packet assembled? Call the file desk.

New York closing taxes and fees, in plain numbers

The rates our calculator runs on, written out so you can check a figure, quote a client or settle an argument without opening a spreadsheet. New York is a filed-rate state: title insurance premiums follow the TIRSA rate manual approved by the Department of Financial Services, and every agency charges the same premium for the same policy. Taxes and recording charges are set by statute and by each county clerk.

Rates shown reflect the schedules in effect as of the date noted on each table. Rates and county charges change. Call us at 631.307.9161 to confirm a figure before you rely on it in a contract or a closing statement.

Mortgage recording tax

PAID AT RECORDING · BORROWER AND LENDER

New York's mortgage recording tax is charged on the principal amount of the mortgage, not the purchase price, and in most counties it is split between the borrower and the lender. In Suffolk and Nassau counties the borrower pays 0.80% and the lender pays 0.25%, for a combined 1.05%. The borrower's share is reduced by a $30 credit where the mortgage encumbers one- or two-family residential property. A refinance is taxed the same way as a purchase money mortgage unless the prior mortgage is assigned and the credit line mortgage or CEMA provisions apply.

New York City rates shown are the combined state and city mortgage recording tax on residential property. A different city rate applies to commercial property and to residential mortgages under $500,000 — ask us for the figure on your file.

Transfer tax and mansion tax

TP-584 · FILED WITH THE DEED
New York State real estate transfer tax 0.4%

$2 for every $500 of consideration, or fraction thereof. Customarily paid by the seller. Reported on Form TP-584 and filed with the deed. New York City conveyances also carry the city's separate Real Property Transfer Tax.

Mansion tax 1%

Applies to residential conveyances where consideration is $1,000,000 or more, calculated on the entire consideration rather than the amount over the threshold. Customarily paid by the buyer. Residential conveyances inside New York City carry additional graduated supplemental rates on top of this 1%.

Peconic Bay Community Preservation Fund tax

EFFECTIVE 04/01/2023 · BUYER

Five East End towns in Suffolk County levy the Peconic Bay Region Community Preservation Fund tax on conveyances of real property. The tax is charged on the consideration above a town-specific allowance and is customarily paid by the buyer. East Hampton, Shelter Island, Southampton and Southold adopted the Community Housing Fund, which raised their rate to 2.5% and limited the allowance to residential property with no allowance at all on conveyances over $2,000,000. Riverhead remains at 2.0%, allows the exemption on commercial as well as residential property, and applies no ceiling.

The CPF form must be filed with the deed in these five towns and printed on legal size paper. It is not required anywhere else in Suffolk County.

Recording charges and ancillary fees

TYPICAL · SUFFOLK AND NASSAU

County clerk recording charges depend on page count, the number of cross-references and the block-and-lot count, so the figures below are the typical all-in charge we use for a standard residential instrument in Suffolk and Nassau. Ancillary search and service fees are Agent Abstract's own charges.

Who customarily pays what

NEGOTIABLE IN THE CONTRACT

These are customs, not rules. Every item below can be shifted by the contract of sale, and custom varies between downstate and upstate New York.

BUYER

Owner's title insurance premium. Lender's policy premium and endorsements. Borrower's share of the mortgage recording tax. Mansion tax. Peconic Bay CPF tax. Municipal and departmental searches. Survey. Deed and mortgage recording charges.

SELLER

New York State real estate transfer tax. New York City Real Property Transfer Tax where applicable. Payoff and satisfaction recording charges. Clearing violations, liens and judgments of record. Nonresident estimated tax on Form IT-2663 where it applies.

Title insurance premiums

TIRSA RATE MANUAL · FILED WITH DFS

Title insurance premiums in New York are not negotiable and do not vary between agencies. They are set by the TIRSA rate manual filed with and approved by the New York State Department of Financial Services, and they are calculated from the policy amount on a sliding bracket schedule — the rate per thousand falls as the amount rises. A simultaneous loan policy issued with an owner's policy is written at a reduced simultaneous rate, and a refinance within ten years of a prior insured mortgage may qualify for a reissue discount.

Because the premium depends on the bracket your policy amount falls in, the reliable way to get the number is the rate calculator or a phone call. We will quote a premium on the spot at 631.307.9161.

Wire fraud warning

Criminals target real estate transactions by impersonating attorneys, agents and title companies over email. Agent Abstract will never send you wiring instructions or a change of wiring instructions by email. Before sending any funds, call our office at 631.307.9161 using a number you have independently verified and confirm the instructions verbally with a person you know. Do not rely on contact information contained in an email.

Please do not include Social Security numbers, bank account numbers or other sensitive financial information in this form. We will collect that information through a secure channel once your file is open.

Submitting this form does not create an attorney-client relationship and does not place a title order. No order is opened until Agent Abstract confirms receipt in writing. Information sent over the internet may not be secure. Any figures quoted are estimates based on the rate schedules then in effect and are not a commitment to insure.

LEGAL

Privacy notice.

How Agent Abstract collects, uses and protects the nonpublic personal information you give us in the course of a real estate transaction.

Effective January 1, 2026

Information we collect

To search title, issue a policy and settle a transaction we collect information from you and from the parties acting on your behalf: names, contact information, property address, transaction terms, the contract of sale, mortgage and payoff information, entity formation documents, and — where a closing requires it — bank account and taxpayer identification information. We also obtain information from public records, including deeds, mortgages, judgments, liens, tax and municipal records, and from underwriters, lenders, attorneys, surveyors and municipalities involved in the file.

How we use it

We use your information only to perform the services you or your representative ordered and to meet our legal and regulatory obligations: conducting searches and examinations, issuing title commitments and policies, preparing closing figures, holding and disbursing escrow and settlement funds, recording documents, and responding to audit, licensing and law enforcement requirements. We do not sell your information, and we do not use it for marketing unrelated to your transaction.

When we share it

We share information as necessary to complete the transaction — with the title underwriter issuing your policy, counsel for the parties, the lender and its servicer, searchers, examiners, surveyors, municipalities and county clerks, and the qualified intermediary on an exchange. We also disclose information where required by law, subpoena, court order, or in response to a regulatory examination. We require the service providers we engage to protect the information we give them and to use it only for the purpose we gave it to them.

How we protect it

We maintain physical, electronic and procedural safeguards designed to protect nonpublic personal information, and we limit access to those employees and agents who need it to do their work on your file. Our practices are intended to comply with the Gramm-Leach-Bliley Act, the New York SHIELD Act, and the New York State Department of Financial Services cybersecurity requirements applicable to licensed title insurance agents. No method of transmission or storage is completely secure, and information sent to us by ordinary email or through a web form is not encrypted in transit.

Wiring instructions and fraud

We will never send you wiring instructions, or a change to wiring instructions, by email. Before transferring funds in connection with any transaction, call our office at a telephone number you have independently verified and confirm the instructions verbally. Report a suspected fraudulent message to us immediately.

Retention

We retain transaction records for the period required by New York insurance and records-retention rules, and for as long as necessary to service a policy that remains in force. Records are disposed of in a manner designed to prevent unauthorized access.

This website

This site does not require an account and does not use advertising or tracking cookies. The rate calculator runs entirely in your browser — the figures you enter are not transmitted to us or stored on a server. Information you submit through the order form is sent to our office for the purpose of opening a file. Please do not include Social Security numbers, bank account numbers or other sensitive financial information in a web form or in an unencrypted email; we will collect that information through a secure channel once your file is open. Links to county clerk and New York State tax forms leave this site and are governed by those agencies' own privacy practices.

Your choices and questions

You may ask us what information we hold about you and request a correction. Some information cannot be changed or deleted because we are required to keep it, or because it comes from the public record. To make a request, or to ask anything about this notice, contact us at the address below. We will update this notice as our practices or the applicable law change, and the effective date above will reflect the current version.

LEGAL

Accessibility statement.

We want every attorney, agent, lender and homeowner to be able to use this site and to order a title report without obstacles.

Effective January 1, 2026

Our commitment

Agent Abstract is committed to making this website usable by people with disabilities. We aim to conform to the Web Content Accessibility Guidelines (WCAG) 2.1 at Level AA, the standard referenced by the Americans with Disabilities Act and the New York State Human Rights Law.

What we have done

The site is built with semantic headings and landmarks so screen readers can navigate it, uses text rather than images of text, meets contrast requirements for body copy, reflows to a single column on small screens and at high zoom, supports keyboard operation of the navigation, calculator and order form, and labels every form field. The rate calculator's results are presented as text that assistive technology can read, and the printable estimate does not rely on color alone to convey meaning.

Known limitations

Some material we link to — county clerk recording forms and New York State tax forms — is published as PDFs by those agencies. We do not control their accessibility. If a linked form is not usable with your assistive technology, call us and we will provide the information or complete the form with you. We review the site periodically and correct problems as we find them.

Alternatives that always work

Anything you can do on this site you can do by telephone. Call 631.307.9161 and we will open a file, quote an estimate, read a form to you, or send information in large print or another format you can use, at no charge.

Tell us about a problem

If you encounter a barrier on this site, we want to hear about it. Tell us the page, what you were trying to do, and the browser or assistive technology you were using. We respond to accessibility reports within five business days and will tell you how and when we expect to fix the issue.
